Section 14
Call for bids

(1) Notice of call for bids or pre-qualification proposals shall be published in national level daily newspapers and in the case of international level bids, it may also be published in international media.
(2) In the case of a central level public body, the notice as per sub-section (1) shall be placed on the website of that body or public procurement monitoring office, and in the case of a district level public body, such notice may be placed on the website of that body or public procurement monitoring office.
(3) In the notice of invitation for bids or pre-qualification proposals, the following should be disclosed:-
(a) Name and address of the public body inviting tenders,
(b) the nature and time limit of the procurement, the place where the goods are to be supplied, the service is to be rendered or the construction work is to be carried out,
(c) Amount and valid period of bid security, if required,
(d) Validity period of bid if bid bond is required,
(e) the place where tender related documents or pre-qualification documents are available, the method of obtaining them and the fees charged for the same,
(f) the place, manner, last date and time of submitting or sending bids or proposals relating to pre-qualification,
(g) date, time, place of opening of bids or pre-qualification proposals and invitation to the bidder or his authorized representative at the time of opening of bids, and
(h) Other matters as specified.
(4) When publishing the notice according to sub-section (1), a period of at least thirty days shall be given in the case of the notice of national level bid or pre-qualification proposal call and at least forty-five days in the case of international level bid or pre-qualification proposal call notice.
(4a) Except in the case of sub-section (5) of section 26, if no bid or pre-qualification proposal is received within the period given for submission of tender or pre-qualification proposal according to sub-section (4) or even if there is no tender or pre-qualification proposal, the re-bidding or pre-qualification will not be effective.If a proposal is called for, the public body may call for a new bid or pre-qualification proposal after giving a period of at least fifteen days in the case of a national-level bid or pre-qualification proposal and at least twenty-one days in the case of an international-level bid or pre-qualification proposal.
(4B) If no tender or pre-qualification proposal is received within the period of giving according to sub-section (4A) or if it is not effective in essence and if not purchased immediately, the public body will be harmed or any work of that body will be stopped, the public body shall explain the reason for it and call for a national level tender or pre-qualification. In the case of a proposal related to eligibility, after obtaining the approval of an officer one level above, a period of up to seven days can be given and the tender can be called again or by choosing a procurement method according to section 8 and according to the same procedure.
(5) In accordance with clause (e) of sub-section (3), when disclosing the place where documents related to bids or documents related to pre-qualification can be found, arrangements should be made to find such documents in two or more public bodies.
(6) According to Clause (f) of sub-section (3), when opening the place of submitting or sending proposals related to tender or pre-qualification, arrangements shall be made to submit or send only to one public body.
(7) According to sub-section (6), if any public body, bidder or proposer requests security for submitting or sending a bid or proposal related to pre-qualification, the concerned district administration office shall compulsorily arrange security arrangements immediately.
(8) The public body may give domestic preference to Nepali entrepreneurs and businessmen in purchases made through international level bidding, as specified, and if domestic preference is given in this way, it should be mentioned in the tender invitation notice and the bidding documents. But in the procurement of the construction work through the national level bidding, only among the domestic bidders up to the estimated costIt can be purchased through competition.
(9) When submitting the bid, the foreign bidder must disclose whether or not he has appointed an agent in the state of Nepal.
(10) If an agent has been appointed according to sub-section (9), the details of the agent should also be mentioned when submitting the bid.
(11) Notwithstanding anything else written in this section, in the case of procurement of public works, if a foreign bidder enters into a joint venture with a domestic construction business, such foreign bidder may be given priority.
